Expanding Access to In Vitro Fertilization In United States 

Starting a family is a dream for many couples and individuals in the United States. However, for some, the path to parenthood is not as simple or straightforward as they had hoped. With such high expenses, many couples find it hard to afford the treatment they need to have a child.  In light of this, the President of the United States has signed an important Executive Order on February 18, 2025, that aims to expand access to IVF. This order focuses on reducing the financial and regulatory barriers that prevent people from accessing these treatments. The goal is to make IVF more affordable and available to families who need it, allowing more people the opportunity to pursue their dreams of having children.  Purpose and Policy of the Executive Order  The primary purpose of this Executive Order is to ensure that all individuals and couples who experience infertility have reliable and affordable access to IVF treatment. The order recognizes that infertility can be a deeply emotional and financially challenging experience for many people. IVF provides a life-changing solution to infertility, offering hope to couples who might otherwise be unable to conceive naturally.  The Executive Order emphasizes that public policy should be aligned with the needs of families across the nation. Lowering Costs and Reducing Barriers to IVF

Within 90 days of the order, the Assistant to the President for Domestic Policy will be tasked with developing a list of policy recommendations to help achieve this goal. These recommendations will focus on making IVF more affordable and ensuring that patients have access to the treatment they need.  The high cost of IVF is one of the biggest barriers to treatment. Even with health insurance, many families are required to pay thousands of dollars out of pocket for each IVF cycle. Additionally, the order aims to reduce regulatory burdens, which can complicate the process of receiving IVF. In Section 3 of the order, it states that nothing in the order will impair the authority granted by law to any executive department or agency. This ensures that the government can continue to operate efficiently and that the necessary structures are in place to implement the provisions of the order.  Furthermore, the Director of the Office of Management and Budget will play an important role in managing the budgetary and administrative aspects of the order. The Limitations of the Executive Order

Section 3(b) of the order makes it clear that the order will be implemented in accordance with existing laws and subject to the availability of appropriations (funding). This means that the impact of the order will depend on the financial resources available to the government. If funding is not available, some of the proposed changes may not be able to take effect immediately.  In addition, Section 3(c) specifies that the order does not create new rights or benefits for individuals. While the Executive Order aims to expand access to IVF, it does not allow individuals to file lawsuits against the government if they are unable to access treatment or if they experience challenges related to the implementation of the order.
